NSW Residential Building Contract for New Dwellings

Read the NSW Residential Building Contract for New Dwellings document before you sign the contract. Ask your Sales Consultant for a copy or purchase a copy from HIA.

Pay particular attention to the following keynotes:
  • Clause 1 - Builder will be entitled to claim any change in the cost of labour and/or materials that may occur through price movements
  • Clause 8.1 - Builder will notify owner by way of a validation letter. Upon receipt of the validation letter from the builder the owner must provide a current letter of commencement/proof of funds to the builder.
  • Clause 9.4 - Builder is entitled to extra costs where the owner is responsible for a delay
  • Clause 12.6 - Owner may end contract if hidden site cost exceeds 5% of the contract price.
  • Clause 16 - Owner may be charge interest on late payment.
  • Clause 17 - Any owner requested variation, will be subjecte to a $1000 processing fee.
  • Clause 21 - Provisional allowance is calculated based on the the difference between the provisional allowance and the actual cost of building works completed plus builder's margin plus GST.
  • Clause 24 - Builder is not responsible for the condition of the existing boundary fences unless it can be shown that the builder caused the damage to the fence.
  • The owner is required to carry out ongoing maintenance to the property in accordance with the Home Care & Maintenance Manual. Failure to properly maintain the property will render the owner liable for any consequaltial damage, loss or expense in relation to the building works.
  • Builder is not resposible for retaining wall and surface drainage requirements and landscaping works in accordance with the requirement of the council
  • Council fees and contributions related to DA due to zoning of land (Fairfield City Council fee is 1.5% of property value)

Welcome

We have been doing our homework for over a year and finally decided go with Masterton. We've selected the Sirocco 7 design for the following reasons:
